MEDICAL MISTAKES ARE THE

LEADING CAUSE OF DEATH IN THE US.

It has been reported that there are as many as 400,000 deaths per year as a result of medical mistakes. In addition there are millions of incidents of medical mistakes each year that do not result in death.

If you or one of your loved ones is injured as a result of medical malpractice, Goldberg Law can help. Typically, in order to establish that an injury or death is the result of a medical mistake, your attorney will obtain the medical records and have them reviewed by an expert witness.  In order for a valid medical malpractice case to exist, we need expert witness testimony that the medical care provided was below the “Standard of Care,”  and that the mistake was a cause of the injury or death.   We also must prove damages which include past medical expenses, future medical expenses, scarring, pain and suffering, and any other economic or non-economic loss that be established.   

 The law imposes a strict deadline on when medical malpractice cases must be filed.  This deadline is called the “statute of limitations.”  This deadline varies from state to state.  It is important to contact a lawyer as soon as possible after medical malpractice is suspected.

Some examples of common medical malpractice lawsuits are: 

  • Birth injuries including Cerebral Palsy, Brachial Plexus, Shoulder Dystocia and infant brain injuries.

  • Failure to properly diagnose and treat cancer cases

  • Medication Errors

  • Negligently performed surgery cases 

  • Failure of Doctor to provide informed consent

 It should be noted that many states impose a cap on the damages that can be recovered in a medical malpractice case.    For example, in Maryland in 2023 the cap on non economic damages in injury cases is $875,000.    The cap on non-economic damages in death cases (with at least 2 claimants) is $1,093,750.  The Maryland cap only applies to non economic damages (e.g. pain and suffering) and does not apply to economic damages (e.g medical expenses and lost wages).
